The code also says how height gets measured, which matters on a sloped yard. Height runs from the ground at the base of the fence to its highest point, and it is taken from the low side. Where the ground drops two feet or more across the line of the fence, the part standing above the high side still has to reach 42 inches. Keeping it up afterwards is the property owner's job under the same section, loose and rotting parts included.
